TERMS AND CONDITIONS

By purchasing a product or service from MichaelaWerner.com, you are agreeing to the following terms. Please read this Agreement carefully before purchasing, accessing, or using any materials, courses, coaching, or services provided by No Ripples Pty Ltd trading as Michaela Werner Freediver.

If you do not agree to these terms, please do not purchase or access our services.

1. Overview

  • The term “Site” refers to michaelawerner.com.

  • The terms “Company,” “we,” “us,” and “our” refer to No Ripples Pty Ltd.

  • The terms “Client,” “user,” “you,” and “your” refer to clients, participants, and any other users of the Site and Services.

  • The terms “Service” and “Program” refer to any paid or free offerings from michaelawerner.com, including courses, workshops, trips, coaching, and digital products.

Use of our Services is subject to these Terms & Conditions and our Privacy Policy.

2. Scope of Services

Our Services include but are not limited to:

  • 1:1 Coaching

  • No Fins, No Worries (online course)

  • Freediving Stage A & Stage B

  • Surf Survival

  • Breath Training for Ocean Swimmers

  • Freediving Trips

  • Underwater Meditation

  • Other services added from time to time.

Access to Services is only available while you are a current paying member or participant.

3. Client Duties

  • Compensation: You agree to pay the listed fees for your chosen Service, either as a lump sum or under an agreed payment plan. Payment plans are a way to make Services more accessible and are not subscriptions that can be cancelled outside the cooling-off period.

  • Late Payment: If payment is more than 10 days overdue, we reserve the right to suspend or terminate your participation.

  • Chargebacks: By providing payment details, you authorise us to charge your card for fees due. Chargebacks without prior written consent are not permitted. You are responsible for any fees arising from chargebacks or collections.

  • Tools & Participation: You agree to provide all necessary tools, information, and effort to benefit from the Services. Your results depend on your participation and commitment.

4. 1:1 Coaching

  • The minimum commitment for 1:1 Coaching is 6 months.

  • If you need to pause coaching for health or personal reasons, you may do so.

  • Coaching must be resumed within 3 months of the pause. If you do not resume within this time, the outstanding balance for the program becomes due immediately.

5. Term

These Terms begin on the date of your first payment and continue until the Service ends, or until terminated by either party in line with these conditions.

6. Cancellation & Refunds

Cooling-Off Period

  • All digital courses include a 14-day cooling-off period from the date of purchase, during which you may cancel for any reason and receive a full refund.

No Fins, No Worries (online course)

  • Refunds available within the 14-day cooling-off period.

  • After 14 days, no refunds are provided.

Freediving Trips

  • Deposits are refundable only within 7 days of purchase.

  • Full payment refunds:

    • 60+ days before trip: 100% refund less deposit.

    • 30–59 days: 75% refund less deposit.

    • <30 days: 50% refund less deposit if the spot is filled; otherwise non-refundable.

Stage A, Stage B, Surf Survival, Breath Training for Ocean Swimmers

  • Cancel 7+ days before: 100% refund.

  • Cancel 3–6 days before: 50% refund.

  • <3 days before: non-refundable.

7. No Guarantees

We cannot guarantee specific outcomes from Services. Your results depend on many factors, including your own participation.

8. Confidentiality

  • Client Information: We will not disclose your confidential information except as required by law.

  • Community Conduct: You agree to maintain confidentiality of other participants in groups, calls, or forums.

  • Non-Disparagement: You agree not to make defamatory statements about the Company, its staff, or participants.

9. Intellectual Property

All content, materials, and resources provided are the property of the Company. You are granted a license for personal, non-commercial use only. Reproduction, distribution, or derivative works are not permitted.

10. Limitation of Liability

  • We are not liable for any injury, illness, or indirect damages.

  • Our liability is limited to the total fees paid by you for the Service.

11. Governing Law & Disputes

These Terms are governed by the laws of New South Wales, Australia.
Disputes will first be addressed through good-faith negotiation.
